Terms of Service
1. About these terms
These terms apply when you read The Peak, sign up for our newsletters, create an account, comment, or buy a Peak Premium subscription or gift. By using the site or our newsletters, you agree to them. If you don't agree, please don't use our services.
Our privacy policy explains what personal information we collect and how we use it. Cookie choices explains the optional cookies you can turn on or off. Both form part of these terms.

2. Who we are
The Peak is published by The Business News Company of Toronto Inc., a company based in Toronto, ON, Canada ("The Peak", "we", "us"). You can reach us through our Contact us page or at [email protected].
3. Your account
You sign in to The Peak with a one-time code we email to you. To create an account you must be at least 16 years old, and the email address must be yours.
- Keep access to your email account secure. Anyone who can read your email can sign in as you.
- Give us accurate information, including the name you use for comments and payments.
- You are responsible for activity on your account. Tell us promptly if you think someone else has used it. You can sign out of other devices from your account page.
- One account per person. Accounts, subscriptions and family places can't be sold or transferred, except by giving a gift as described in section 7.
- You can ask us to delete your account through Contact us. We keep payment records we are required to keep, as our privacy policy explains.
4. Newsletters and email
We send our newsletters and email marketing messages only to people who sign up for them. You choose which newsletters you get, and you can change your choices on your account's Email and settings page or unsubscribe using the link in any newsletter.
Our newsletters are delivered by Beehiiv, our email provider. Some emails are part of your account or purchase, such as sign-in codes, receipts, family invitations, gift notices and payment reminders. We send those even if you have unsubscribed from our newsletters.
5. Peak Premium subscriptions
Peak Premium renews automatically until you cancel. Your card is charged at the start of each monthly or yearly period, and you can cancel at any time from your account.
Plans and prices. Prices are shown on our upgrade page in Canadian dollars, plus any applicable taxes. Payments are processed by Stripe; we do not store your full card number.
Renewal. When you subscribe, you authorize us to charge your payment method at each renewal at the price then in effect. We will tell you at least 30 days before a price change applies to you, and you can cancel before it does.
Offers and trials. Some offers give a discount or a free or reduced-price trial. Each offer shows its terms before you pay. Unless you cancel before a trial ends, your card is charged the regular price when it does. Offers can be limited to new subscribers, to certain plans, or to a set period, and can't be combined.
Changing plans. Upgrades, such as moving to Premium Family, take effect right away with a prorated charge shown before you confirm. Downgrades take effect at your next billing date.
Cancelling. You can cancel from Manage subscription in your account. Your access continues until the end of the period you have paid for, and you won't be charged again.
Failed payments. If a payment fails, we and Stripe will retry it and ask you to update your card. We may end your subscription if payment can't be collected.
Refunds. Payments are non-refundable, including for partly used periods, except where the law requires otherwise. The only exceptions are if you request a refund within 7 days of your payment being processed, or otherwise at our discretion. If you think you were charged in error, contact us immediately. Your billing history and receipts are on your account page.
What Premium includes. Premium gives access to paywalled stories, Premium newsletters, and other benefits listed on the upgrade page. We may change what is included from time to time at our sole discretion. Changes to benefits do not entitle you to a refund.
6. Premium Family
A Premium Family subscription covers the account holder and up to three other people. The account holder pays for and manages the subscription.
- Inviting people. The account holder can invite people by email or share an invitation link. Invitations expire after 14 days. Anyone who accepts a shared link takes a place, so share it only with people you mean to include.
- Joining. A person can belong to only one family. Joining a family doesn't cancel a subscription you already pay for; cancel that yourself if you no longer need it.
- Removing and leaving. The account holder can remove members, and members can leave at any time. A freed place can be filled again after 24 hours.
- When the subscription ends. Members keep access only while the account holder's Family subscription is active. If it is cancelled, lapses or is switched to an individual plan, members lose Premium access when it ends.
- Family places are for the account holder's household, family or friends, not for resale or business use.
7. Gift subscriptions
A gift gives the recipient one year of Peak Premium, paid once by the giver. It does not renew and the recipient is never charged.
- Buying. You need an account to buy a gift. You can have us email it on a date you choose, or get a link to pass on yourself. Anyone with the link can claim the gift, so keep it private until you share it.
- Claiming. A gift can be claimed once, within 12 months of purchase. After that it expires. A reader who already has paid Premium access, through their own or a family subscription, can't claim a gift; pass it on to someone else instead.
- The gift year. The year starts when the gift is claimed. We email the recipient a week before it ends. Premium stops at the end of the year unless the recipient chooses to subscribe.
- Refunds. A gift that hasn't been claimed can be refunded on request to the giver within 30 days of purchase. Claimed gifts can't be refunded.
- Gifts have no cash value and can't be resold.
8. Our content
The stories, newsletters, audio, games, charts, photos, content, logos and design on The Peak belong to us or our licensors and are protected by copyright and trademark law. We give you a personal, non-commercial licence to read, listen to and share them as described below.
You may:
- Read and listen for your own use, and save stories to your account.
- Share links to our stories, and occasionally forward a newsletter to a friend.
- Quote short passages with credit to The Peak and a link to the original.
You may not:
- Republish, sell or distribute our content, or copy Premium content for people who don't have access without our written permission.
- Get around the paywall, registration wall or any other access control.
- Scrape, crawl or bulk-download the site, or use our content to train or feed AI or machine-learning systems, without our written permission.
- Remove copyright notices, credits or labels, or suggest that we endorse you.
For licensing or reprint requests, contact us.
Audio narration. Some stories are read by an automated voice. Narration may contain errors; the written story is the authoritative version.
Accuracy. We work to be accurate and correct mistakes when we find them. Our content is general news and information, not financial, investment, legal or tax advice. Talk to a qualified professional before making decisions based on it.
9. Comments and what you send us
Comments must follow our comment guidelines, which you agree to before your first comment. We may hold, remove or decline to publish any comment, and block anyone who breaks the guidelines or these terms from commenting.
Your content stays yours. When you post a comment or send us a poll answer, survey response, tip or feedback, you keep ownership of it. You give us a worldwide, royalty-free, non-exclusive licence to publish, edit for length or clarity, display and share it on The Peak, in our newsletters and on our social channels and on any other channels we own, with your display name and location if you gave them. Comments show the name on your account, so don't use a name you don't want shown publicly.
Don't post or send anything that:
- is unlawful, defamatory, harassing, hateful, threatening or sexually explicit;
- infringes someone else's copyright, trademark, privacy or other rights;
- impersonates someone, or shares another person's personal information;
- is spam, advertising or links to malicious software.
Using the site. Don't interfere with the site or its security, test it for vulnerabilities without our permission, create accounts automatically, or use our sign-in codes, invitations or gift links in ways they were not meant for. If you've found a security problem, please tell us.
10. Advertising and sponsored content
The Peak shows ads and sponsored messages, each clearly labelled "Sponsored" or "Advertisement".
Ads on the site are served by us, not by ad networks.
An ad links to the advertiser's own site, and anything you buy there is between you and the advertiser. We aren't responsible for their products, services or claims.
11. Other sites and services
Our stories link to other websites, and we use outside services to run The Peak. Their own terms and privacy policies apply when you use them directly. We don't control other sites and aren't responsible for their content.
Optional cookies and third-party features, such as analytics or embedded media, load only if you allow them on our Cookie choices page. Our privacy policy explains what each one does.
12. Disclaimers and limits on our liability
We provide The Peak "as is". We work to keep it running and accurate, but we can't promise it will always be available, error-free or secure, or that every story is complete and current.
To the extent the law allows:
- we are not liable for indirect, incidental or consequential losses, such as lost profits or lost data, arising from your use of The Peak;
- we are not liable for decisions you make based on our content;
- our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or CAD 50 if you haven't paid us anything.
Nothing in these terms limits rights you have under consumer protection laws that can't be waived, including in Quebec.
You agree to cover our reasonable losses if a claim is made against us because of content you posted or your breach of these terms.
13. Ending access, changes and the law that applies
Suspension. We may suspend or close an account, or stop someone from commenting, if they break these terms, misuse the site or put other readers at risk. If we close a paid account without cause, we will refund the unused part of the current period.
Changes to these terms. We may update these terms as the site changes. We will post the new version here with its date and, for changes that materially affect subscribers, email you at least 30 days before they apply. If you keep using The Peak after that, the new terms apply. If you don't agree, you can cancel before they take effect.
Governing law. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario.
Other things. If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce a term right away, we can still enforce it later. These terms, with our privacy policy, are the whole agreement between you and us about The Peak.
